Welcome to Capitack, a non-custodial cryptocurrency trading platform. These Terms of Use ("Terms") govern your access to and use of Capitack ("Platform"). By accessing or using the Platform, you agree to these Terms. If you do not agree, please discontinue use of the Platform immediately.


1. Non-Custodial Service

1.1 No Wallet Provision

  • Capitack does not provide wallet or custody services. You must use your own wallet to send and receive digital assets.
  • You are solely responsible for any loss resulting from incorrect wallet details or misuse of personal wallets.

1.2 Irreversible Transactions

  • Cryptocurrency transactions are irreversible. Once initiated, trades cannot be canceled.
  • Capitack bears no responsibility for losses due to user errors such as providing an incorrect or unsupported wallet address.

1.3 No Control Over Crypto Fluctuations

  • Cryptocurrencies are highly volatile. Capitack does not control or influence market prices.
  • You acknowledge the inherent risks of trading crypto assets, including potential loss of your entire investment.

2. Supported Use Cases

2.1 Buy Crypto with Fiat

  • Users can purchase supported cryptocurrencies by sending fiat currency via an accepted payment method (e.g., bank transfer).
  • The purchased cryptocurrency will be transferred to the user’s designated wallet address.

2.2 Sell Crypto for Fiat

  • Users can sell supported cryptocurrencies by sending them to Capitack’s designated address.
  • The corresponding fiat amount will be transferred to the user’s registered bank account.

2.3 Crypto-to-Crypto Swaps

  • Users can swap one supported cryptocurrency for another.
  • Ensure your wallet supports the specific crypto and network you will receive.

3. User Accounts

3.1 Account Creation

  • To access the Platform, you must create an account with accurate and up-to-date information.
  • You must be at least 18 years of age (or the legal age in your jurisdiction).

3.2 Account Security

  • You are responsible for maintaining the confidentiality of your login credentials.
  • Notify Capitack immediately of any unauthorized access or suspicious activity in your account.

3.3 Verification Requirements

  • Capitack reserves the right to request additional information or documentation for identity verification at any time (e.g., KYC/AML compliance).
  • Failure to provide requested information may lead to account suspension or termination.

3.4 Right to Suspend or Terminate Accounts

  • Capitack may, at its sole discretion, suspend or terminate your account for reasons including (but not limited to) suspected fraud, unlawful activity, or violation of these Terms.
  • Decisions made by Capitack regarding account suspension or termination are final.

4. Payments and Transactions

4.1 No Third-Party Payments

  • Fiat payments must originate from a bank account in your own name.
  • Third-party payments are strictly prohibited and may result in transaction cancellation or account suspension.

4.2 Payment References

  • Do not include references to “cryptocurrency,” “Bitcoin,” “crypto,” or any token name in payment descriptions or references.
  • Payments with prohibited references or from mismatched accounts may be delayed or rejected.

4.3 Supported Networks

  • Many tokens (e.g., USDT) can exist on multiple networks (Ethereum, TRON, BNB Smart Chain, etc.).
  • Capitack only supports the specified network for a given trade. Sending funds on an unsupported network will result in permanent loss.

4.4 No USSD Transfers

  • Transfers must be made via methods that can clearly identify the sender’s name (e.g., online banking or bank apps).
  • This ensures compliance and minimizes the risk of fraud.

5. Privacy and Data Handling

5.1 Information We Collect

  • Login credentials (email, username, password).
  • Identifying data (if required by KYC/AML regulations).
  • Technical data such as IP addresses and device information.
  • Transaction logs and Platform usage data.

5.2 How We Use Your Data

  • To operate and secure the Platform.
  • To comply with legal and regulatory obligations.
  • To prevent fraud, money laundering, and other illicit activities.
  • To improve our services and user experience.

5.3 Data Retention

  • We retain user data only as long as necessary for operational or legal compliance.

5.4 Data Sharing

  • We may share your information with third-party partners to facilitate transactions or with authorities if legally required.
  • We do not sell or rent your personal data to unaffiliated third parties for marketing purposes.

6. Fraud, Scams, and Third-Party Disclaimers

6.1 No Affiliation with Unsolicited Parties

  • Capitack is not affiliated with any third parties who contact you unsolicited, asking for money or crypto “on behalf of Capitack.”
  • If you receive such requests, you are most likely being scammed. Always verify with Capitack through official channels.

6.2 Scam Warning Signs

  • Unsolicited Requests: Individuals claiming to represent Capitack or urgent “investment opportunities.”
  • Promises of High Returns: Unrealistic or guaranteed profit statements are often indicative of scams.
  • Pressure Tactics: Threatening or rushing you to send funds without proper verification.

6.3 No Liability for Third-Party Losses

  • Capitack is not liable for losses resulting from fraudulent schemes or third-party scams.
  • Users must exercise due diligence in verifying the legitimacy of all communications and instructions.

7. Risks and Disclaimers

7.1 Market Volatility

  • Cryptocurrency prices can fluctuate drastically in short periods.
  • You may lose some or all of your investment when trading or holding cryptocurrencies.

7.2 User Decision and Responsibility

  • Trading decisions and risk assessments are your responsibility alone.
  • Capitack does not provide financial, investment, or legal advice.

7.3 No Warranty

  • Capitack provides the Platform "as is" without any warranties or guarantees of availability, performance, or suitability for a particular purpose.

7.4 Limitation of Liability

  • To the fullest extent permitted by law, Capitack is not liable for any direct, indirect, incidental, or consequential damages arising from:
    • User errors (e.g., incorrect wallet addresses, wrong networks).
    • Losses due to market volatility.
    • Actions or inactions of third-party partners.
    • Fraudulent activities or scams involving third parties.

8. Regulatory and Compliance

8.1 Legal Compliance

  • You agree to comply with all applicable laws and regulations in your jurisdiction, including those related to taxation, AML, and KYC.
  • Capitack reserves the right to refuse service if we suspect a violation of any applicable law or regulation.

8.2 Jurisdiction

  • These Terms are governed by and construed under the laws of Isle of Man.
  • Any disputes will be resolved in the courts of Isle of Man, unless otherwise required by applicable law.

9. Platform Modifications and Termination

9.1 Platform Availability

  • Capitack may modify, suspend, or terminate the Platform or specific services at any time, with or without prior notice.
  • You agree that Capitack is not liable for any modification or termination of the Platform.

9.2 Termination of These Terms

  • If you violate these Terms or if your account is terminated, your right to use the Platform ceases immediately.
  • Sections relating to liability, disclaimers, and data usage shall survive termination.
